Affirmative asylum is an option for those who have already entered the United States but have not yet been placed in removal proceedings. To apply, you must be present in the United States and you must have arrived within the last year.

After you file your asylum application, you will meet with an asylum officer. They will assess your application and the reason you’re seeking asylum. If they grant it, you will be permitted to stay in the United States and apply for permanent residency. If not, your case will be referred to immigration court and you enter the defensive asylum process.
