Presentation of the Initiative

Starting August 19, 2024, the application process will open for the program announced by the Biden administration, offering eligible spouses of U.S. citizens the chance to obtain legal status without leaving the country. Announced in July, the program will evaluate each case individually. Eligibility requirements include demonstrating continuous residence in the U.S. for at least 10 years before June 17, 2024, being physically present in the U.S. without lawful admission or parole, posing no threat to public safety, and being in a valid marriage with a U.S. citizen prior to June 17, 2024.

Addressing the Challenges

The new parole program addresses significant immigration challenges by allowing eligible individuals to apply for status adjustment from within the United States. This eliminates the need to leave the country for visa interviews and avoids triggering lengthy reentry bans. Even if the program is suspended or reversed in the future, those granted parole may still have a path to pursue lawful permanent residency.

Eligibility Requirements

To qualify for Parole in Place, applicants must meet specific criteria, including having resided continuously in the U.S. since at least June 17, 2014, and being legally married to a U.S. citizen before June 17, 2024, among other conditions. The program is expected to benefit approximately 500,000 spouses and 50,000 children of U.S. citizens, providing them with legal status and the ability to work while awaiting further immigration processes.

Impact on Immigrant Services

For Serving Immigrants, the parole-in-place program represents a major opportunity for eligible individuals to gain permanent residency. It also offers a meaningful response to long-standing challenges within the U.S. immigration system.
