The T visa is granted to individuals who have suffered from human trafficking. This type of visa is essential for providing security and stability to victims while they collaborate with authorities in the investigation and prosecution of traffickers, helping to dismantle exploitation networks. Human trafficking differs from migrant smuggling, which involves bringing people into the United States without involving forced labor or sexual exploitation.

There are two types of human trafficking: the first is labor trafficking, in which the victim is forced to work against their will without receiving payment. The second is sex trafficking, in which the victim is forced into prostitution or other types of sexual work, such as in strip clubs or massage parlors. Many traffickers deceive victims by offering jobs and then force them into prostitution through threats to the victim or their loved ones.

Being a victim of severe human trafficking: this means you suffered from sexual or labor trafficking, which includes being forced or threatened to engage in those activities.

Being present in the U.S. due to trafficking: the applicant must be in the U.S. or at a port of entry as a direct result of human trafficking.

Report the trafficking and cooperate: Provide proof of reporting the trafficking and cooperating with reasonable requests in the investigation or prosecution.

Prove extreme hardships if deported: The applicant must show they will face severe trauma or revictimization, beyond economic loss.

Prove continuous presence in the U.S.: Stay in the U.S. without leaving for more than 90 days at a time, or 180 days combined, over three years.

Have good moral character and be admissible: No serious crimes committed and be considered admissible under U.S. immigration laws.
