A Texas judge has temporarily suspended the "Parole In Place" program for spouses of U.S. citizens.
"Parole in Place" is a program that speeds up the process for foreign spouses of U.S. citizens to obtain legal status. The decision to suspend it represents a setback for Joe Biden’s immigration policy, just weeks before the presidential election.
President Biden’s plan, announced in June, aimed to benefit approximately half a million undocumented immigrants in the United States. However, Federal Judge Campbell Barker in Tyler, Texas, accepted a lawsuit filed by 16 Republican state attorneys general.
These attorneys general accused the Biden administration of circumventing Congressional jurisdiction and implementing the measure for political purposes.
The U.S. Citizenship and Immigration Services (USCIS) stated in a release that the court’s decision "does not affect requests approved before the issuance of the ruling." It clarified that, while new applications cannot be approved during the suspension, USCIS will continue to accept applications through Form I-131F.
The suspension of "Parole in Place" has several implications for immigrants and their families:
Immigrants who were in the process of applying for "Parole in Place" may face increased legal uncertainty. Without this temporary protection, they could face the possibility of deportation or be required to leave the country to apply for legal status, which can be risky and complicated.
For families eligible to apply, the suspension may result in increased stress and difficulties in the process of regularizing their immigration status. This could affect family stability and their ability to stay together.
The suspension could also lead to changes in application processes and eligibility criteria. Interested parties should stay informed about new official guidelines and seek appropriate legal advice to understand their options.
